Conspiracy to Commit a Drug Crime
If a West Chester, Chester County, or Pennsylvania law enforcement officer believes that two or more individuals were involved in the commission of a drug crime, it is common to charge those individuals with conspiracy. In drug cases it may be a conspiracy to possess the drug or controlled substance or a conspiracy to sell, manufacture or distribute the drug or controlled substance. A conspiracy to commit a drug offense is present when two or more individuals are found to have: 1. Agreed to commit or attempt to commit a drug offense, or 2. Agreed to aid each other in the planning or commission of a drug crime or of an attempt or solicitation to commit such crime AND there is found to be an overt act done in furtherance of the conspiracy.
In West Chester and other areas of Chester County it is not uncommon that more than one individual is arrested in connection with a drug crime and both/all are charged with conspiracy to commit the drug offense.
In these situations a skilled criminal defense lawyer should be consulted in order to determine the potential defenses that may be available in these cases. Often times, there has been no conspiracy and/or there are not sufficient facts or evidence to prove a conspiracy to commit a drug crime has occurred. Conspiracy cases typically involve very fact specific defenses. It is important that someone charged conspiracy to commit a drug crime in West Chester, Chester County or anywhere in the surrounding area consult a skilled criminal defense attorney to analyze the case and begin preparing a defense.
